BOGENHOLM PROEPRTIES, LLC - REQUEST FOR ‘VARIANCE[S]'

  

  

        Call to Order.            Planning Commission Chairperson Bill Hayden called the April 14, 2008, Public Hearing and Special Meeting of the Moose Lake Planning Commission to Order, at or about, 5:30 p.m.  Planning Commission Chairperson Bill Hayden asked those in attendance to join with the Planning Commission in reciting the Pledge of Allegiance.  In addition to Chairperson Bill Hayden, the following Commissioners were in attendance:  Mayor Ted Shaw, City Councilor Curt Yort and Greg Sarvela.  Commissioners absent:  Cindy Kaspszak.  Also in attendance was City Administrator David Talbot, Jr., who also serves as the City Zoning Administrator.

 

 

        New Business.                       

 

1.         Bogenholm Properties, LLC - Request for Two [2] ‘Variances'.  City/Zoning Administrator Talbot stated that the City was in receipt of an application and the requisite fees from Bogenholm Properties, LLC, the applicant[s], requesting consideration regarding the granting of two [2] ‘Variances' from the requirements of the City Zoning Ordinance, Ordinance No 104.  If granted, the ‘variances' would allow for the construction of a handicapped accessible Group Home on a sub-divided portion of Lot 8, Block 1, State Hospital Plat [Parcel ID 21-220-0160], which is also known as 924 Lakeshore Drive.  The applicant[s] have submitted a site survey [plan] showing the location of three [3] separate parcels of developable land, as well as the location of numerous easements that traverse the property.  The first ‘variance' would be for a ‘front yard setback' variance from the thirty-five [35] foot requirement under Ordinance No 104, to a proposed front yard setback of five [5] feet.  It is important to note that although the five [5] foot front yard setback seems closer than one would normally desire, the property line is also an easement and the applicant[s] own the adjacent lot, which is almost unbuildable due to the number of easements in place.  The second ‘variance,' if granted, would allow for a ten [10] foot rear yard setback.  Normal ‘rear yard setback' requirements of City Ordinance No 104, the City Zoning Ordinance is thirty-five [35] feet for a Single Family Residence District.

  

City/Zoning Administrator Talbot asked that the Public Record state that notices were sent to the nine [9] abutting and adjacent property owners that may be affected by the granting of the ‘variances'.  City/Zoning Administrator Talbot stated for the Public Record that he, Talbot, did receive several telephone inquiries, but they were of a nature and kind wishing to know what was being proposed and where it would specifically be located.  There being no further discussion or deliberation on the matter, a Motion was introduced by Mayor Ted Shaw, and with a second to the Motion being made and offered for consideration by Planning Commissioner Greg Sarvela, the aforementioned and defined ‘variances' were recommended for approval.  Motion carried unanimously via voice vote.  [4-0]. 

           

       Announcements.        City/Zoning Administrator Talbot reported that the next Regular Meeting of the Moose Lake Planning Commission, if needed, is scheduled for Tuesday, April 29, 2008, at 5:30 p.m., in the City Council/Town Board Chambers, Moose Lake Area Civic and Community Center.

 

 

       Adjournment.            There being no further business to come before the Moose Lake Planning Commission, Chairperson Bill Hayden called for a Motion to Adjourn the Monday, April 14, 2008, Public Hearing and Joint Special Meeting of the Moose Lake Planning Commission.  A Motion to Adjourn was introduced by Commissioner Greg Sarvela, and a second to the Motion to Adjourn was made and offered by Commissioner Mayor Ted Shaw.  Motion approved unanimously via voice vote [4-0].   Meeting adjourned by Planning Commission Chairperson Bill Hayden.
